Rules and Regulations 2010
Day
to day conduct, operations and control of the Kelowna Farmers' and Crafters'
Market (herein called The Market) shall be governed in accordance with
the following Rules and Regulations:
1. AIM:
The mandate of the market is to sell homemade or grown products
sold by the producer. Generally speaking, no used or purchased goods may
be sold. All products shall be sold by the producer or an immediate family
member or by a helper.
2. HOURS
OF OPERATION:
The Market shall operate between the hours of 8 a.m. and 1 p.m.,
April through October. Season pass vendors must be on site 60 minutes
prior to market opening. At the discretion of The Market Manager,
their stall may be assigned to another vendor.
Day vendors must be on site 30 minutes prior to The Market opening.
No vendor will be permitted to pack up their stalls until the bell
rings at 1 p.m. without the permission of The Market Manager. The
Market manager will remain on site until 1:30 p.m.
3. DAILY FEES:
Daily stall fees are $50.00 for a single
stall (10 feet by 22 feet) for the first
day at The Market and $25.00 for each day thereafter.
If two stalls are required (16 feet by 22 feet) the fees shall be $75.00
for the first day and $50.00 for each day thereafter. All daily fees are
payable upon entrance to The Market. The maximum rental fee payable for
a season site is $600 for single stall and $800.00 for a double stall.
It is the responsibility of the day vendor to keep all receipts and notify
The Market Manager once he/she has reached this cap.
4. STALL
ALLOCATIONS:
Stalls shall be allocated in accordance with the designated parking
plan. Unassigned stall spaces will be filled on a first come first
served basis.
5. JURY
COMMITTEE APPROVAL:
All vendors must
obtain Jury Committee approval for the products they sell prior
to selling them at The Market.
6. WEIGH
SCALES:
Where vendors are selling products by weight,
they must have scales that have been certified in accordance with
the provisions of the Weight Measures Act (Canada).
7. PRODUCT
RESTRICTIONS:
Products that MAY NOT BE
SOLD unless approved by the appropriate jurisdiction (i.e. Ministry
of Health, Provincial Government, City of Kelowna, etc.) include:
* Dairy products (milk, cream, cheese, yoghurt,
etc.)
* Meat, fish, poultry or products thereof
* Cakes, pies, tarts or bread products that
have syrup,
frosting or topping on the
surface or that have
cream cheese filling
8. VENDOR
RESPONSIBILITY:
The onus is on the
vendor to ensure appropriate compliances and approvals have been
obtained prior to selling their goods at The Market. All vendors
shall immediately cease to sell and will remove from The Market
any products upon the request of any official or representative
of the aforementioned jurisdiction or of The Market Manager.
9. SALES
TAX:
The vendor is responsible for collecting and remitting
applicable taxes.
10. STOREFRONTS:
Vendors conducting a storefront operation (exclusive
of farmgate sales) shall not be permitted to sell from The Market.
11. HOUSEKEEPING:
All persons occupying stall spaces are SOLELY
responsible for keeping their stall space and surrounding area clean
and tidy during and upon departure of The Market.
12. DOGS:
No dogs (except for service dogs) or other animals
will be permitted at The Market.
13. CONDUCT:
There shall be no hawking, accosting or badgering
of the members of the public.
14. RESTRICTIONS:
The Market Manager reserves the right to limit
the sale of any commodity and the distribution of literature, political
or religious material, or any article deemed not to be in the best
interest of The Market. Petitioning and soliciting will be strictly
prohibited from The Market. The Market Manager may, at his sole
discretion, prohibit any person from renting stall space and may
require persons to leave The Market in the event that the said person
fails to or refuses to abide by these RULES OF OPERATION.
15. LIABILITY:
Vendors selling produce do so at their own risk
regarding marketing boards.
16. LOST
- STOLEN - DAMAGED:
The Market is not responsible for lost, stolen or damaged
goods or money.
17. ORGANIC
CERTIFICATIONS:
Vendors selling produce as organically grown,
must be CERTIFIED. A certification must be shown to The Market Manager
upon request. All signage relating to organic produce must be approved
by The Market Manager.
18. HOME
VISITS:
All vendors are subject to home visits by directors
and/or The Market manager to verify all products being sold are
produced or made by the vendor.
19.
SECURE AWNINGS:
All awnings and tents shall be properly secured.
20. NOTIFICATION
OF ABSENCE:
All season pass members
must notify The Market Manager the day before a market by 7 PM if not
attending a market. If a vendor fails to notify The Market Manager of
his/her absence, the right to hold a reserved stall at The Market may
be forfeited for the entire season. Call The Market Manager at (250) 878-5029
to cancel a market. No E-mails Please!
21. PARKING:
All vendor vehicles
that are not parked behind their stall set-up (unless approved by
the Market Manager) must park their vehicles for the Saturday and
Wednesday markets next to the pub across Dilworth.
22. GEOGRAPHICAL
BOUNDARIES:
Boundaries for vendors selling at the Kelowna
Farmers & Crafters Market are Armstrong to Summerland, unless
it is a unique product that is not being sold at The Market.
A vendor must obtain prior approval from the Jury Committee or has
been grandfathered in.
23. NO
SMOKING:
THERE IS ABSOLUTELY NO SMOKING ON MARKET SITE AT ANY
TIME.
24. NSF:
A $30 fee will be applied to N.S.F. CHEQUES.
25. PRE-BOOKING:
Approved Farmers
are allowed to book the day before a market between the hours of
5 PM to 7 PM. If the Farmer fails to use his/her stall site after
booking, the right to book will be forfeited for the entire season.

EMPLOYEES:
A vendor can now
have an employee (s) sell their product without the owner being
present at the market.
